This Data Processing Agreement ("DPA") forms part of the Terms of Service or other agreement for services ("Principal Agreement") between NewNagaOffer ("Processor" or "we") and the client ("Controller" or "you") engaging our services.

This DPA reflects the parties’ agreement with regard to the processing of Personal Data in accordance with the requirements of Data Protection Laws.

Definitions

• "Data Protection Laws" means all applicable laws relating to data protection and privacy including (but not limited to) the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, as applicable.
• "Personal Data" means any information relating to an identified or identifiable natural person processed by the Processor on behalf of the Controller in connection with the provision of services under the Principal Agreement.
• "Processing" means any operation or set of operations which is performed on Personal Data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
